1. Agreement to Terms

By accessing and using America's Garage Doors services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and America's Garage Doors LLC.

2. Service Description

America's Garage Doors provides professional garage door installation, repair, maintenance, spring replacement, opener services, and related services throughout Jacksonville Beach and Duval County, Florida. We reserve the right to modify or discontinue any service at any time without notice.

All services are subject to availability and our licensed technicians' schedules. While we strive to provide same-day service when possible, we cannot guarantee specific response times. Service estimates are valid for 30 days unless otherwise specified.

3. Pricing and Payment

All prices quoted are estimates and subject to change based on actual conditions encountered during service. Final pricing will be provided after comprehensive service assessment and before work begins. Payment is due in full upon completion of services unless other arrangements have been made in advance in writing.

We accept various payment methods including cash, check, and major credit cards. A minimum service fee may apply for all service calls. Emergency, same-day, or after-hours services are subject to additional fees. Returned checks will incur a $35 fee plus any applicable bank charges.

Prices do not include applicable sales taxes, permits, or disposal fees unless specifically stated. Customer is responsible for all costs associated with permit requirements.

4. Warranties and Guarantees

We warrant our workmanship for a period of one (1) year from the date of service completion. Manufacturer warranties apply separately to all parts and equipment installed, ranging from 90 days to lifetime depending on the product. These warranties do not cover damage resulting from misuse, neglect, abuse, accident, acts of God, unauthorized modifications, or failure to perform recommended maintenance.

Garage door springs are wear items and carry a limited warranty based on cycle rating. Weather seals, rollers, and other wear components have limited warranty coverage. The warranty does not cover cosmetic issues that do not affect functionality.

In the event of a valid warranty claim, we will repair or replace the defective work or parts at no charge. This is your exclusive remedy under this warranty. All warranty claims must be submitted in writing within 10 days of discovering the defect.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICA'S GARAGE DOORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SERVICES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, LOST PROFITS, OR BUSINESS INTERRUPTION.

Our total liability for any claim, whether in contract, tort, negligence, strict liability, or otherwise, shall not exceed the amount paid for the specific service in question. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

Customer assumes all risk of injury or property damage that may result from garage door operation after our service is complete. Garage doors are heavy mechanical systems with inherent risks. Customer is responsible for ensuring all users are properly instructed on safe operation.

6. Safety and Assumption of Risk

Garage door systems contain high-tension springs, heavy moving parts, and electrical components that can cause serious injury or death if improperly handled. Customer acknowledges that garage doors are potentially dangerous mechanisms and agrees to:

• Never allow children to operate or play near garage doors
• Keep hands, fingers, and clothing away from moving parts
• Never attempt to repair or adjust springs, cables, or other tension-bearing components
• Test safety features monthly and report malfunctions immediately
• Ensure proper clearance and that the door path is clear before operation

We are not responsible for injuries or damages occurring after service completion that result from misuse, tampering, or failure to follow safety instructions.

7. Cancellation and Rescheduling

Service appointments may be cancelled or rescheduled with at least 24 hours advance notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee of up to $75. Emergency service calls are non-refundable once a technician has been dispatched.

If we arrive at your location and are unable to complete the service due to circumstances beyond our control (locked gates, aggressive pets, unsafe conditions, inaccessible work area), a trip charge will apply.

8. Customer Responsibilities

Customers are responsible for:

• Providing clear, safe access to the work area and garage door system
• Securing pets during service appointment
• Removing vehicles and obstacles from the garage
• Ensuring adequate lighting and electrical power at work site
• Disclosing all known issues, previous repairs, and potential hazards
• Being present or having an authorized adult (18+) present during service
• Maintaining garage door system according to manufacturer recommendations

Failure to provide accurate information about your garage door system or existing conditions may void warranties and result in additional charges.

9. Property Access and Damage

We will make reasonable efforts to protect your property during service. However, we are not responsible for damage to landscaping, driveways, or other property features when accessing the work area with equipment. We are not liable for pre-existing damage to garage walls, ceilings, or structures that may become apparent during or after service. Customer should notify us immediately of any concerns regarding property damage.

10. Indemnification

Customer agrees to indemnify, defend, and hold harmless America's Garage Doors, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from customer's breach of these terms or misuse of the garage door system after service completion.

11. Dispute Resolution and Arbitration

Any disputes arising from our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Duval County, Florida.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS. Each party shall bear their own costs and attorney fees unless otherwise awarded by the arbitrator.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action must be filed within one (1) year of the date the cause of action arose.

13. Licensing and Insurance

America's Garage Doors operates under Florida contractor license #GD13 and specialty license #ST-5595. We maintain appropriate liability insurance and workers' compensation coverage as required by law. Copies of licenses and insurance certificates are available upon request.

14. Entire Agreement and Severability

These terms, along with any written service agreements or estimates, constitute the entire agreement between you and America's Garage Doors. These terms supersede any prior oral or written agreements.

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to update these terms at any time without prior notice. Continued use of our services after changes constitutes acceptance of the modified terms. The most current version will always be available on our website.
